2] The learned Counsel for the applicant submitted that, despite best efforts being put in, the respondent No.1 could not served with the notice and therefore the present application has been filed. 3] For the reasons stated in the application, the application is allowed in terms of prayer clause (a).

4] The applicant to publish the notice in the said two newspapers within a period of six weeks from today and file an affidavit to that effect after the publication.
