Heard learned counsel for applicant and learned APP. By this application, applicant seeks extension of time by two weeks to furnish surety alleging that though as per order dated 11th February 2016 passed by this court, applicant was directed to be released on bail on suspension of his sentence and was directed to furnish bail bonds before the Sessions court within three weeks, the writ of this court was received before the Sessions court after lapse of two weeks. It is contended that applicant has already produced his surety and process avk 1/2
903-APPA-526-2016.doc of acceptance of surety is in progress. Learned counsel for applicant points out that though vide this application time is prayed to be extended by two weeks, he is orally praying for extension of time for four weeks saying that in the event of non-compliance of process of acceptance of surety, such time be extended.
Considering the fact that applicant's sentence is suspended and he is directed to be released on bail and is further directed to furnish bail bond as stated aforesaid, and since applicant says that he has already produced his sureties whose acceptance is in progress, application is allowed.
Time to furnish surety is further extended by four weeks. Application stands disposed of.
Needless to say that non bailable warrant if any issued by the learned Sessions court be stayed for a period of four weeks. (P. N. DESHMUKH, J.) avk 2/2
