This petition filed under Section 11(6) of the Arbitration and Conciliation Act for appointment of an Arbitrator, in view of dis-agreement between the parties for selection of an Arbitrator. There is no dispute as regards existence of the Arbitration agreement and the arbitral dispute. Clause 6 of the Memorandum of Understanding dtd. 1st April, 2013 provides for resolution of the dispute by a sole arbitrator to be appointed mutually by the parties. Clause further provides that the place of arbitration shall be at Pune and the agreement shall be subject to Pune jurisdiction. In that circumstance, Mr. S.M. Deshmukh, the retired Principal District & Sessions Judge,

2/3 residing at Block No.13/14, Building No. "O", Kumar Park-Off Kondhwa Road, Bibwewadi, Pune- 411 037 is appointed as an Arbitrator for resolution of the dispute between the parties. The parties shall approach the Arbitrator on/or before 28th October, 2015. The petition is disposed off.
