The application is filed for condonation of delay of 38 days occurred in filing an application for leave to appeal. In pursuant of the notice issued by this Court to the respondents, the respondents have filed an appearance. However, none appears on their behalf when the matter is called out today. By making averments in paragraphs 2 to 9, the applicant has explained the delay. We find the explanation to be satisfactory and, we therefore, condone the delay. The criminal application is accordingly allowed in terms of prayer clause (a) and is disposed of as such.
