DATED : 30th MARCH 2023 P.C:- On 4/04/2019 the 4 appellants in the two appeals were held entitled for interim relief in the event of their arrest in CR No. 38 of 2019 registered with Lasalgaon Police Station, which had invoked the provisions of the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities Act),1989.
Notice was also issued to the complainant.
As on today the interim orders still continue to remain in operation with an additional development that on 4/08/2022 on Ashish Mhaske
2/2 20 APEAL 547-19.doc completion of investigation in the subject CR the charge-sheet has been filed.
The respondent no.2 is represented through the counsel Mr. M.V. Rajput from Legal aid would not dispute the position of filing of the charge-sheet.
Since the object of the custodial interrogation is to ensure the investigating agency to submit their investigation and file the final report under Section 173, that stage having been brought and the appellant reporting to the Investigating Officer as directed by the Court's order dated 4/04/2019, I deem it appropriate to confirm the order dated 4/04/2019.
Since Advocate Mr. M.V. Rajput has been appointed by legal aid for the purpose of espousing the cause of the respondent no.2, I would like to record my appreciation for the strenuous efforts taken by him.
The legal services authority is directed to pay the legal remuneration to him within a period of six weeks from today. ( SMT. BHARATI DANGRE, J.) Ashish Mhaske
