The learned counsel for the appellant seeks permission to withdraw the First Appeal.

Permission is granted. The First Appeal stands disposed off as withdrawn.

Needless to state that on the First Appeal, being withdrawn, the claimants shall be entitled to the compensation awarded to them under the impugned judgment alongwith the interest accrued thereon and the Tribunal shall permit withdrawal of the same by the claimants.

On withdrawal of the First Appeal, refund of court fees, as per rule, shall be made over to the Insurance Company. M.M.Salgaonkar

The amount of Rs.25,000/-, which has been deposited in this Court by the Insurance Company, shall be remitted to the Tribunal and it shall be permitted to be appropriated by the claimants.
