At the outset, Mr. Manoj Patil, learned counsel appearing for the Petitioners seeks withdrawal of the Writ Petition with liberty to challenge the order dated 16th October 2019 passed by learned Civil Judge, Senior Division, Kolhapur below Exhibit-44 in Regular Civil Suit No.88 of 2015, in the appeal if ultimately the decree in the said Regular Civil Suit is passed against the Petitioner.
