Mr. Yagnik, learned APP, at the outset, stated that after completion of the investigation into the subject FIR, charge-sheet is already filed. In support of his statement, he has placed on record the reports dated 15th December, 2016 and 8th August, 2016 respectively of the Deputy Police Commissioner, Zone -VI, Mumbai. 2.
In the above circumstances, Mr. Shine, learned counsel for the petitioner, seeks leave to withdraw the petition with liberty to approach the magistrate by filing appropriate proceedings. Leave with liberty as prayed for, is granted. The writ petition is dismissed as withdrawn.
