It is submitted that the respondent No.2 has fled proceedings before respondent No.1 under Section 3H of the National Highways Act, 1956.

As the proceedings are already pending before the respondent No.1, the respondent No.1 shall take a decision on its own merits and in accordance with law and after hearing all the parties concerned and the decision with regard to the disbursement be taken only after the respondent No.1 decide the objections.

3.

The learned AGP shall communicate this order to the Competent Authority.
