The petitioner no. 1 herein was mentally ill for more than 30 years. The petitioner no. 1 was first taken to the Sir J.J. Group of Hospitals, Mumbai, he was given some medical treatment for his physical ailments. After psychiatric evolution, the petitioner no. 1 was shifted to the Regional Mental Hospital, Thane.

As per report of the Regional Mental Hospital, Thane, the petitioner no.1 is now cured and is not required to remain as an indoor patient.

Learned counsel for the petitioners submits that the sister of the petitioner no.1 was looking after the petitioner no.1, however, she does not have financial resources to take care of the petitioner no. 1. In that scenario, we had asked learned AGP about the steps undertaken by the State to take care of such citizens.

Learned AGP, on instructions, submits that the petitioners can file an application with the Commissioner, for Persons with Disabilities, Pune and considering the conditions, he would be shifted to Half-way Home where the care of the petitioner no. 1 will be taken.

The petitioner no.1 certainly will have a discharge card from the Regional Mental Hospital, Thane. The petitioners shall make an application to the Commissioner, for Persons with Disabilities, Pune. The application of the petitioners shall be processed by the Commissioner, for Persons with Disabilities, Pune, within a week from receiving the application of the petitioners and effective steps shall be taken for rehabilitation of the petitioner no. 1 at the cost of the State.

With the aforesaid observations and directions, the writ petition is disposed of.

Till the decision is taken by the Commissioner, for Persons with Disabilities, Pune, as stated above, the

petitioner no. 1 shall remain with the Regional Mental Hospital, Thane.
