Though Rule was issued on 26th August 2004, the petition is pending as the Bhatta charges are not paid and the copies are not supplied for effecting service. It shows shocking state of affairs. The writ petition ought to have been listed before the Court or before the Registrar in the year 2004 itself. But for a period of 13 years, this petition has not seen the light of the day.
The Registrar (Judicial-I) shall call for explanation from the members of the staff as to why this petition was not listed earlier either before the Court or before the Registrar.
We grant time of two weeks to the petitioner to supply copies of this petition for effecting service of notice. As the learned AGP represents the first respondent-State of Maharashtra, it is
wp6302 not necessary to serve notice of Rule to the first respondent. If the petitioners fail to supply adequate number of copies within the stipulated time, the petition shall stand dismissed for non prosecution without further reference to the Court. If copies are supplied, Rule notice be issued to all concerned respondents returnable on 28th August 2017. Notices be forwarded through the concerned Court with a special messenger.
