The applicant, who is original accused no. 4, was convicted under sections 302, 377, 363 and other sections of Indian Penal Code. The applicant is now seeking bail.

It is the prosecution case that the applicant along with other accused kidnapped Minakshi, who was 3 1/2 years old and subjected her to anal sex and thereafter strangulated her. The applicant had earlier preferred an application for bail, which was rejected by detailed order on 14th August, 2009. No fresh ground has been pointed out for reconsideration of the prayer for bail except that the applicant has been in custody for a long 1 / 2

2.APPA531_2016.doc period of time. However, the record shows that the Appeal has already been placed on the Final Hearing Board in the week commencing from 10th October, 2016. In this view of the matter, we are not inclined to grant bail. Application is rejected.
