P.C.:- This is an Application under Section 439 of the Code of Criminal Procedure for bail in CR No. I-234 of 2018 dated 29th July, 2018, registered with Naupada Police Station, District Thane under Sections 302, 201, 363, 364, 365, 120-B of the Indian Penal Code. Heard the learned counsel for the Applicant and the learned APP. Perused the charge-sheet.

The learned counsel for the Applicant submitted that, the co-accused namely Bhaskar Nurangikar, who has been attributed with same and/or similar role in the present crime has been released on 1/3

ssm 2 914-ba1091.19.doc bail by this Court by its Order dated 30th January, 2019 and therefore, the Applicant may be released on bail on the ground of parity. The learned APP fairly conceded to the said fact. Perusal of charge-sheet would indicate that, there is substance in the submission of the learned counsel for the Applicant. The witness namely Santosh Pande has attributed role of assault by fist and kick blows to the Applicant so also to the co-accused Bhaskar Nurangikar. In view thereof, the Applicant is entitled to be released on bail on the ground of parity.

Hence, the following order.

a) The Applicant be released on bail in No. CR No. I234 of 2018 dated 29th July, 2018, registered with Naupada Police Station, District Thane on his furnishing PR bond of Rs.25,000/- with one or two solvent local sureties in the like amount.

b) After his release from Jail, the Applicant shall attend to the concerned Police Station once in a month on first Saturday of every month between 11.00 a.m. and 1.00 p.m. till further order.

ssm 3 914-ba1091.19.doc c) After his release from Jail, the Applicant shall attend all the dates before the Trial Court unless exempted by the concerned Court.

d) Any two consecutive defaults in complying with the afore-stated condition will attract the provisions of cancellation of bail.

e) The Applicant shall not tamper with the evidence and/or pressurize the prosecution witnesses.

f) Application is allowed in the aforesaid terms. (A.S. GADKARI, J.) 3/3
