Heard the Learned Advocates appearing for the parties. The following Order passed by consent.
(i) The Learned Civil Judge Senior Division, Barshi at Solapur shall allow the parties to convert the Hindu Marriage Petition No.14 of 2017 into a Petition seeking divorce by mutual consent and pass a decree of divorce by mutual consent within a period of two weeks from today.
(ii) Both the parties unconditionally withdraw the allegations made by them against each other in the respective proceedings filed by them. (iii) The proceedings filed by the Applicant-wife in the J.M.F.C. Court at Vashi under the Protection of Women from Domestic Violence Act, 2005 shall be withdrawn within a period of one week from the Learned Civil Judge Senior Division,
kpd 2 / 2 909-MCA-190-2017.sxw Barshi, Solapur granting a decree of divorce. (iv) The Respondent-husband has paid an amount of Rs.3,00,000/- to the Applicant in full and final settlement of her claim towards her alimony and maintenance of the minor child.
(v) The Respondent-husband shall handover to the Applicant the Certified Copies of the caste certificates of the Respondent and his father within a period of two weeks from today.
(v) The Respondent-father shall be entitled to access as agreed in paragraph No.3 of the Consent Terms which were drafted before the Mediator. (vi) Save and except what is stated herein, parties have no claim against each other.
(vii) All concerned to act on an ordinary copy of this Order duly authenticated by the Private Secretary of this Court. 2.
