The plaintiff in Short Cause Suit No. 1887 of 2015 has challenged the order dated 18th March, 2016 passed by the Judge, City Civil Court, Greater Bombay, whereby an application objecting to the jurisdiction of the Court filed by defendant no.6 was allowed. The plaintiffs had filed a suit for declaration that the election of defendant no.6 as a

Defendant no.6 challenged the jurisdiction of the Court to try and entertain the suit. The objection has been upheld vide order dated 18th March, 2016. The learned Counsel appearing for respondents no.1 and 4 has pointed out that elections were held for the term 2015 and 2017 which is also evident from para-2. In view of this, the petition is now rendered infructous and therefore dismissed with no order as to costs.
