By an Order dated 10.4.2018 the applicant was granted interim relief. .

Heard the learned counsel for the applicant, learned counsel for the intervener and the learned APP. Perused the record.

The first information report itself indicates that the applicant is the financee of the brother-in-law of the first informant. The applicant has no direct relation with the Page-1/2

17-aba-684-18 first informant. Except general allegations made against the applicant, no specific overt act is attributed to her in the F.I.R.

In view of the decision of the Supreme Court in the case of Arnesh Kumar vs. State of Bihar and anr. reported in (2014) 8 SCC 273 the applicant is entitled to be protected by pre-arrest bail.

In view of the above, the interim relief granted by Order dated 10.4.2018 is hereby conformed. However, the condition to report the Investigating Officer is waived. 6.

Application is allowed in the aforesaid terms. 7.

In view of the disposal of ABA No.684/2018, the Criminal application No.650/2018 does not survive and the same is accordingly disposed off.
