The petitioner is challenging the charge-sheet in RCC No.3853 of 2019 pending before the learned Judicial Magistrate, First Class, 4th Court, Pune. Vide order dated 28th March 2023, the learned Judicial Magistrate First Class, Court No.4, Pune has framed the charge against petitioner and other accused for offence under Sections 341 read with 34 of Indian Penal Code, 1860 (for short "IPC"), Section 386 read with 24 of IPC, Section 506

(2) read with 34 and Section 500 read with 34 of the IPC. 2.

Learned Advocate for petitioner seeks permission to withdraw this petition with liberty to challenge the order dated 28th March 2023 passed by learned Magistrate framing charge in RCC No.3853 of 2019. Dnyaneshwar Ethape, P.A.

In the event, the question of delay in preferring the proceedings challenging the order dated 28th March 2023 arises, the fact that the petitioner was pursuing this petition challenging the proceedings since date of its filing will have to be taken into consideration. 5.
