Heard learned counsel for the Petitioner.

It is the contention of learned counsel for the Petitioner that the Appeal under Section 152 of the Maharashtra Co-operative Societies Act, 1960 is pending before the Hon'ble Minister against an enquiry initiated under Section 88 pursuant to the order passed by the District Deputy Registrar which is at page 15 of the paper book. It is pointed out that vide order dated 03.01.2018 which is at page 65 of the paper book the Hon'ble Minister exonerated a Director similarly situated as the Petitioner by allowing a connected Appeal. It is the contention of learned counsel for the Petitioner that the Petitioner is similarly situated as the Appellant in the connected Appeal which is allowed by the Hon'ble Minister. It is pointed out that since 2016 the Petitioner's Appeal is pending and

4.WP.4101-21.doc the application for stay is yet to be decided. Considering these facts, in my opinion, following order will meet the ends of justice :-

O R D E R

(i) The Hon'ble Minister is requested to decide the Appeal filed by the Petitioner which is at page 400 of the paper book expeditiously.

(ii) Till the Appeal is decided the order dated 27.01.2016 passed by the District Deputy Registrar which is at page 15 of the paper book shall remain stayed.

All contentions on merits are kept open.

I may not be understood to have expressed any opinion on the merits of the controversy.

The Writ Petition is disposed of.
