The Applicant herein apprehends his arrest in Crime No. 815 of 2017 registered at Baramati City Police Station for the offences punishable under section 452, 354, 423, 504 r/w. 34 of the Indian Penal Code. 2.

It is the case of the prosecution that the Complainant had filed a report at the police station alleging therein that she is running a hotel in the name of 'Lahugarden' at Phaltan Road, Baramati. On 20th December, 2017, the present 1/3

Applicant and his two associates had entered into the hotel at about 10.30 p.m. and insisted upon the dinner being served at that time. She had disclosed that the hotel was closed. However, they had assaulted her and had also intimidated. They had touched her inappropriately and abused her orally. The Applicant was protected by an order dated 10th April, 2018. 3.

In view of the above mentioned facts, interim order deserves to be confirmed.

The observations are restricted to an application under section 438 of Cr.P.C. and shall not be taken into consideration for the purpose of quashing of FIR, discharge application or at the time of trial. 5.

Hence, the following order is passed.

ORDER

(i) In the event of arrest, the Applicant be enlarged on bail on furnishing P.R. Bond in the sum of Rs. 25,000/- and one or more sureties in the like amount.

(ii) The Applicant shall report to the concerned police station as and when called.

Application is allowed in the aforesaid terms. and disposed of accordingly.
