Learned counsel appearing for the appellant and respondent no.2 submits that their respective clients hereby withdraws L.C.Suit No.1202 of 2009 and S.C.Suit No.2821 of 2012 which were filed in the City Civil Court at Mumbai in view of this consent terms. Statement is accepted. Both the learned counsel agree

Appeal from order is disposed of in the aforesaid terms. In view of disposal of the appeal from order, civil application does not survive and is accordingly disposed of. No order as to costs.
