Heard. By this petition under Article 226 of the Constitution of India, the Petitioner seeks direction against Respondent No.2 to decide the tribe claim of the Petitioner, as early as possible.

As per order dated 25.06.2021, the learned AGP has filed Affidavit-in-Reply dated 08.07.2021 duly affirmed by the Research Officer/Member of the Scheduled Tribe Certificate Scrutiny Committee, Pune stating that they will decide the said Application within 2 months from the date of receipt of Vigilance Cell Report. Paragraph 2 of the said Affidavit-in-Reply reads thus:

I say that at present the matter is pending before Vigilance Cell. I further say that after obtaining an enquiry report from the Vigilance Cell, the Petitioner's application for caste validity certificate will be decided expeditiously and preferably within a period of 2 months from the date of passing of order in the above Writ Petition. I say that the said period is required for following the due procedure under the law."

In view of the affidavit dated 08.07.2021, nothing survives in the Writ Petition.

Hence, the Writ Petition stands disposed of with direction to the Respondent to decide the Petitioner's Application for caste validity certificate, as early as possible, as per paragraph No.2 of the Affidavit-in-Reply dated 08.07.2021.

No order as to costs.
