This application is preferred by insurance company for stay of operation and implementation of Judgment and Award dated 03.09.2010 passed by the Motor Accident Claims Tribunal, Nashik in M.A.C.P. No. 508 of 2006.
The learned Counsel for the applicant submits that they have already deposited entire awarded amount in the Tribunal.
Considering the submissions made by learned counsel for the applicant and averments made in Sneha Chavan 1/2
15 caf 2075-11=.doc civil application, I am satisfied that applicant has made out the case for allowing the civil application. Hence, civil application is allowed in terms of prayer clause (a), which reads thus:
"a) Pending the hearing and final disposal of the abovesaid First Appeal, the execution, operation and implementation of the impugned Judgment and Award dated 03.09.2010 passed by learned Member, Motor Accident Claims Tribunal, Nashik at Nashik in M.A.C.P. No. 508 of 2006, be stayed."
