DATED : 6th JUNE, 2022 P.C:- Recording a prima facie case in paragraph no.3 of the order dated 22/4/2022, the applicant was directed to be released on interim bail in connection with C.R.No. 106/22 registered with Amboli Police Station. The applicant was directed to report to the Investigating Officer on 25th and 26th April 2022. Heard the learned counsel for the applicant and learned APP for the State.
The nature of dispute highlighted in the First Information Report can be simply termed as dispute/discord between the landlord and tenant. The applicant is the owner of Tilak
2/2 32 ABA 1100-22.doc the premises and had leased out the same on leave and licence basis to the informant. It appear that there was default in paying the rent on account of the pandemic situation, which had constrained the applicant to change the door of the said flat since the licence period had expired and the complainant failed to either vacate the premises nor even clear the dues. The case of the applicant is specifically to the effect that opportunity was given to the complainant to remove her belongings. In any case, the aforesaid nature of allegations surely do not entitle for custodial interrogation.
The applicant was already protected from arrest on 22/4/2022. The said order deserve to be confirmed subject to the condition being imposed upon the applicants that they shall render co-operation to the Investigating Officer and shall report to the police station as and when called for.
