By this application, the applicant / original accused is seeking condonation of his breach in complying the condition of bail order so also for relaxation of condition directing him to report to the Sessions Court, Pune, once in six months on the date specified by the learned Sessions court.

905-APPA-611-2017.doc Heard both sides and perused the application as well as annexures thereto. It is seen that, due to some ailment and particularly Bipolar mood disorder the applicant / original accused could not report to the Sessions court from 2nd June 2015. In this view of the matter, this lapse deserves condonation as averments are supported by papers of medical treatment placed on record.

The applicant / accused is directed to report to the Sessions court, Pune, once in six months during pendency of his appeal. The appeal will take its own time for disposal. Hence, Condition no.3 of the order dated 26th November 2013 in Criminal Application No.1620 of 2013 is relaxed by directing the applicant / accused to attend the Sessions court, Pune, once in every year. He should report the Sessions court, Pune, in first week of January each year.
