1] By the present civil application, the applicant wishes to amend the petition, which came to be admitted on 20th March 2014. It is stated in the civil application that the amendment is required to bring on record certain facts which happened after the petition was filed. The petition was filed some time in December 2010. The petitioner basically wants to bring on record the fact that he was dispossessed from the suit premises and the subsequent petition that he had filed and the orders passed.
YBG caw1231-14.doc 2] Respondent Nos. 1 to 3 have filed reply. The respondent Nos. 4 and 5, Counsel for the petitioner states, are not necessary parties for deciding this application.
3] I have considered this civil application and the reply. In the reply, the respondents have dealt with the contents of the application on merits but as regards whether allowing or not allowing the civil application, they have left it to the court. 4] In these circumstances, the civil application is allowed in terms of prayer clause (a). Amendments to be carried out within two weeks from today and a copy of the amended petition be served upon the respondents within one week thereafter. Should the respondents wish to file any reply to the petition, they may do so within two weeks of receiving a copy of the amended petition. ( K.R.SHRIRAM, J.)
