Heard Mr.Cheulkar, learned Counsel for the Applicant/Appellant and Mr.Damre, learned Counsel for Respondent Nos.1 to 4.

This application is moved for restoration of First Appeal which was dismissed on 13 September, 2010 for want of non compliance. In the absence of non compliance of order passed by this Court on 13 September, 2010, the paper book was not filed within one year.

Mr.Cheulkar, learned Counsel for the Applicant, submitted that inadvertently paper book was not filed within time. He submitted that he is ready to file paper-book within four weeks and prayed to condone the delay in filing this application. 1/2

In view of the submissions made by the learned Counsel for the Applicant Insurance Company, Appeal is restored alongwith the applications.

The Paper-book shall be file within four weeks from today and if the same not filed within four weeks, then it shall dismissed without reference to the Court.
