At the outset, Mr. Vagal, the learned Counsel for the appellant, on instructions, submits that since the co-accused have been released on temporary bail by the learned Special Judge, the appellant seeks leave to withdraw the appeal with liberty to prefer an application for temporary bail before the learned Special Judge.
