First Appeal Stamp No.10897 of 2017 came to be rejected for non depositing of Deficit Court Fee.

Learned AGP points out that in fact the Deficit Court Fee was paid on 24th April, 2017. For the reason the First Appeal stands restored to its original status.

Learned AGP informed that in the Appeal is challenging enhancement of the amount of compensation by the Learned Reference Manoj

2 907-FA(ST)-10897-2017.doc Court i.e. 3rd Joint Civil Judge, Senior Division, Nashik, in L.A.R. No.351 of 2007 by way of Judgment & Order dated 14th February, 2014. Learned AGP submits that the Learned SLAO had awarded an amount of Rs.22,559/-. The same came to be enhanced to Rs.45,359/-. Enhancement is thus within four times of the amount awarded by the SLAO. 4.

Learned AGP thus submits that in view of the GR dated 3rd November, 2016 and 11th May, 2018 bearing No.Sankirn-2014/P.K.41/part1/A-4, he seeks leave to withdraw the Appeal. 5.

Leave is granted.

Appeal stands disposed of as withdrawn.

In view of withdrawal of the Appeal, pending Civil Applications, if any, stand disposed of.

8.

The Court Fee to be refunded as per Rules.
