IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION WRIT PETITION NO.1675 OF 2017 Prakash Rama Rawool

...Petitioner

vs.

The State of Maharashtra and Ors.

...Respondents

AND CRIMINAL APPLICATION NO.349 OF 2017 ---- Mr. Rahul I. Tiwari for the Petitioner.

Mr. Ganesh Bhujbal for the Applicant.

Mr. Sooraj S. Hulke, APP for the Respondent/State. ---- CORAM : B. P. DHARMADHIKARI, ACTING CHIEF JUSTICE & N. R. BORKAR, J.

DATE : 25/02/2020.

P.C.:

.

Petitioner claims that he and 8 other persons paid Rs.16,000/- each to private persons. They raised construction on it which was demolished in due course of time as petitioner did not have any title to that land. Even before this Court the petitioner is not in position to point out any title. They have not bothered to verify title of their vendor. Had the structure been not demolished, they would not have bothered to approach police or Court of law.

2.

Learned APP and learned advocate for intervener submits that earlier FIR was registered and in it statement of present petitioner was recorded as witness. Later on that case was dismissed. 3.

We do not see any merit in the submission of the petitioner.

rsk 2/2 7-WP-1675-17.doc 4.

If the petitioner and others have got any cause of action they can approach any other forum in accordance with law. No case is made out for exercise of extraordinary jurisdiction. The petition is therefore rejected. Pending Criminal Application No.349/2017 is also disposed of. (N. R. BORKAR, J.) (ACTING CHIEF JUSTICE)
