Learned Counsel for the petitioner, on instructions, wants to withdraw the petition. He submits that the petitioner was earlier a respondent in appeal and he was not party in the suit but was made respondent in appeal. Then, on his application, he was transposed as appellant No.2. His mother was appellant No.1 who died pending appeal.

Now, on instructions, he wants to withdraw the Writ Petition with liberty to file an application for amendment of appeal memo. The petitioner is accordingly allowed to withdraw the Writ Petition

Writ Petition is disposed of as withdrawn.
