Heard learned Counsel for the parties.

By this Civil Application, Applicant is seeking restoration of First Appeal No. 1186 of 2011 which stands dismissed in view of conditional order dated 19.01.2015 passed by this Court for non deposit of costs of Rs.500/- in the office of Maharashtra State Legal Services Authority, High Curt, Bombay.

The learned counsel for the Applicant submits hat inadvertently it remained on their part to comply the said order. He submits that the Applicant is ready and willing to deposit the said costs within four Sneha Chavan 1/2

Considering the submissions made by the learned counsel for the Applicant and the averments made in the Civil Application, I am satisfied that the Applicant has made out a case for allowing the Civil Application. Hence, following order is passed:

a) Delay in filing Civil Application is condoned.

b) Applicant to comply the order dated 19.01.2015 on or before 30.11.2019 and place on record the receipt to that effect, failing which the Civil Application shall stand dismissed without further reference to the court c) If costs is paid within time, First Appeal No. 1186 of 2011 is restored on file for hearing on its own merits.
