By this application, the applicant seeks pre-arrest bail in connection with C.R. No. 104 of 2014 registered with the Malabar Hill Police Station for the alleged offences punishable under Sections 420, 465, 468, 471 of the Indian Penal Code read with Sections 74(1) (B), (E), (2),

(4) and (5) of the Maharashtra Value Added Tax, 2002. 2.

Learned A.P.P, at the outset, has raised an objection that the anticipatory bail application No. 2472 of 2014 was dismissed not on merits but for want of prosecution. She states that the applicant can file an application for restoration of the said anticipatory bail application, which SQ Pathan 1/2

aba.565.15.doc was dismissed for want of prosecution.

In view of the objection raised, the learned Counsel for the applicant seeks leave to withdraw this application with liberty to move an appropriate application seeking restoration of the Criminal Anticipatory Bail Application No. 2472 of 2014.

Accordingly, the applicant is permitted to withdraw this application with liberty as prayed.

If such an application is made, the learned Judge to consider the same on merits in accordance with law, as expeditiously as possible, without being influenced by the withdrawal of the present application. 6.

Application is accordingly disposed of as withdrawn with liberty as aforesaid.
