By this application, the applicant seeks pre-arrest bail in connection with LAC No.4 of 2018 registered with the Wadala T.T.Police Station, Mumbai for the alleged offence punishable under Section 135 of the Electricity Act.

Perused the papers with the assistance of the learned APP. It

2/3 appears that the officer of the Vigilance Electric Supply Department, Mumbai, has lodged a complaint, as against the Applicant alleging theft of electricity to the tune of Rs.2,42,573/- (for loss of 11,592 KWH units) with compounding charges Rs.24,000/-. The applicant has deposited Rs.1,25,000/- with the Vigilance Electric Supply Department, Mumbai. 4.

Learned APP states that the application filed before the reassessment Authority has been allowed and the final amount has been deposited i.e. Rs.1,51,260/-.

It appears that the applicant has deposited a sum of Rs.1,25,000/- with the Vigilance Electric Supply Department, Mumbai, and the reassessment order has also been passed.

Considering the aforesaid, custodial interrogation of the applicant is not necessary. Accordingly the application is allowed and the applicant is granted pre-arrest bail on the following terms and conditions :

ORDER

(i) In the event of the arrest, the applicant be enlarged on bail on

3/3 executing P.R. Bond in the sum of Rs.15,000/- with one or two sureties in the like amount;

(ii) The Applicant shall co-operate with the Investigating Agency. 7.

The Application is allowed in the aforesaid terms and is accordingly disposed of.

It is made clear, that the observations made herein are prima facie and are confined to this application.
