The learned counsel for the Petitioner, in view of the judgment of the Division Bench of this Court reported in 2016 Cri.L.J. (NOC) 102 (Bom.) in the matter of Avinash Trimbakrao Dhondage v/s. State of Maharashtra, seeks withdrawal of the above Writ Petition to file a Revision Application before the Sessions Court. The above Writ Petition is accordingly allowed to be withdrawn and dismissed as such. Needless to state that the Revision Petition that would be filed by the Petitioner would be heard and decided on its own merits and in accordance with law.
