Heard the learned counsel for the Applicant and learned APP for the State.

The applicant is accused of the offence punishable under section 302 r/w. section 34 of the Indian Penal Code. He is ordered to be released on bail by the Sessions Court in the sum of Rs.50,000/- with two solvent sureties of Rs.25,000/- each. The learned counsel for the applicant prays that the bail amount may be reduced. Such a prayer made before the Sessions Court has been rejected.

spb/ 904apl387-15.doc It is submitted that the applicant is from poor strata of the society and is unable to furnish bail to the extent of Rs. 50,000/-. I have gone through the impugned order. It appears that the applicant has played a very marginal role in the alleged offence. In the circumstances, the order of the learned Sessions Judge is modified as under : i. The applicant shall be released on bail in the sum of Rs. 20,000/- with one solvent surety in the like amount or two sureties of Rs.10,000/- each.

ii. Rest of the conditions of the bail imposed by the learned Sessions Judge shall remain the same. This application stands disposed of.
