The Applicants have applied for transit bail apprehending their arrest in C.R.No.93/2023 registered at Mahila Thana, Dist. Bhopal, Madhya Pradesh for offences punishable under sections 406, 498(A), 506 r/w. 34 of the Indian Penal Code.

Heard learned counsel for the Applicants and learned APP for the State. I have perused the records and considered the submissions advanced by the learned counsel for the respective parties. 3.

The crime against the Applicants was registered pursuant to the FIR lodged by Respondent No.3. The marriage of the Respondent No.3 and Applicant No.1 was solemnized on 26/02/2022. It appears that marital 1/2

P.H. Jayani 05 ABA1060.2023.doc discord between the Applicant No.1 and Respondent No.3 led to filing of the FIR. The Applicants apprehend their arrest and seeks transit bail for a period of four weeks to enable them to approach the appropriate Court at Bhopal, Madhya Pradesh and to seek appropriate relief. In my considered view, the apprehension of arrest is reasonable. 4.

Considering the accusations in the FIR, the Applicants are entitled for transit bail. Hence, the Application for transit bail is allowed on the following terms and conditions :- (a) In the event of arrest of the Applicants in C.R.No.93/2023 registered at Mahila Thana, Dist. Bhopal, Madhya Pradesh, they shall be released on transit bail for a period of four weeks on furnishing bail bonds in the sum of Rs.25,000/- each with one or two sureties in the like amount ; (b) This protection is granted for a period of four weeks from the date of the order to enable the Applicants to approach the Competent Court for seeking appropriate relief.
