The application is filed for bail in C. R. No.32 of 2015 registered in Police Station for the offences punishable under Sections 363, 364(A), 365 etc of Indian Penal Code. Both sides are heard. Papers of investigation are made available for perusal of this Court.

The crime is registered on the basis of the report given by Meghna Mohan Lele, the wife of victim. Accused No.1 is their son-in-law. It appears that since 2014 there is no cohabitation between the daughter of victim and Accused No.1. Allegations are Aswale 1/3

made that on 17th January, 2015 in the morning time, Accused No.1, son-in-law of the victim, along with his friends including the present Applicant, forcibly put the victim in four wheeler and they tried to extract amount of Rs. 50,00,000/- and they were also asked to send daughter of victim for cohabitation. No medical record is there on record. The statement of one Police Officer is there. It appears that Police trusted the victim as report was given of his probable kidnapping by the wife of the victim. The learned APP submits that the Applicant has bad antecedents and as many as eight incidents were recorded against him. She has produced the report given by the concerned Police Station in this regard. The Applicant has been behind bars since February 2016. It is not certain as to how much time will require to complete the trial.

Considering the nature of the dispute which can be seen in the allegations, this Court holds that it is not desirable to keep the Applicant behind bars till disposal of the case. In the result the application is allowed. The Applicant is to be released on bail on his furnishing P. B. and S. B. of Rs. 30,000/-(Rupees Aswale 2/3

Thirty Thousands Only) with one or more solvent sureties of the like amount. The Applicant is not to tamper with the prosecution witnesses. The Applicant is not to commit similar offences. (T.V.NALAWADE, J.) Aswale 3/3
