Heard Mr. Mehta learned counsel for the petitioner and Learned APP Ms.Deshmukh.

Petition is filed seeking direction to the respondent to register FIR on the basis of the petitioner's complaint dated 23-01-2014. There is no dispute that on the basis of this complaint the police have registered NC complaint. That apart, we have gone through the allegations in the same complaint. It does not discloses commission of cognizable offence. In the circumstances petitioner has an efficacious alternative remedy N.S. Kamble page 1 of 2

5-wp-1659-2015 to approach concerned Magistrate by way of Private Complaint, if he has any grievance. We do not find any merit in this petition. Hence petition is dismissed.

Needless to mention that the issue raised in the petition and the complaint shall be decided on its own merit and without being influenced by the observations made in this order.
