The above Writ Petition has been filed seeking a direction against the Respondent for return of the passport of the Petitioner bearing No.R4110672. The Petitioner was required to deposit the passport with the Investigating Agency in terms of the conditions mentioned by the order dated 7-2-2014 passed by the Learned Additional Chief Metropolitan Magistrate 47th Court, Esplanade Mumbai. The record of the Writ Petition discloses that the Petitioner at various times has applied for return of passport so as to enable him to travel abroad which permission has been granted by the Trial Court. In view of the fact that the deposit of the passport is a condition imposed at the time of granting bail to the Petitioner, we do not deem it appropriate to issue the directions sought by the Petitioner in the above Writ Petition and relegate the Petitioner to the remedy of applying before the Trial mmj

If any application is filed by the Petitioner for return of the passport / permanent return of the passport, needless to state that the same would be heard and decided on its own merits and in accordance with law. With the directions as aforesaid, the above Writ Petition is disposed of.
