This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The applicant came to be arrested in Crime No. 74 of 2020 registered at Lasalgaon Police Station, Nashik for the offences punishable under Sections 302, 201 of Indian Penal Code. 3.

I have heard the learned Counsel for the applicant and the learned APP for the State.

According to the prosecution, on 22 March 2020 the present applicant and other co-accused committed the murder of the deceased as Kanchan P Dhuri 1 / 2

16-BA-1209-2021.odt they were annoyed with him and the reason was prior to the alleged incident the deceased had threatened them to intimate about their illegal activities to the police.

The case is based on circumstantial evidence. The applicant is in jail for about 3 years. There are no other criminal antecedents. Considering the overall facts and circumstances of the case, I am inclined to release the applicant on bail. Hence, the following order is passed : (i) Application is allowed.

(ii) The applicant - Sachin Rama Kale be released on bail in Crime No. 74 of 2020 registered at Lasalgaon Police Station, Nashik for the offences punishable under Sections 302, 201 of Indian Penal Code on furnishing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount.
