P.C.:- After hearing the learned counsel appearing for the Applicant at length, when this Court was not inclined to grant any relief, the learned counsel, on instructions, seeks leave to withdraw the present Application with liberty to file a fresh Application for bail before the Trial Court, if the trial arising out of CR No. 587 of 2015 registered with MIDC Police Station, Mumbai, now culminated in Sessions Case No. 12 of 2016 pending on the file of Additional Sessions Judge, Borivali Division, Dindoshi, Mumbai does not conclude within a period of one year from today. Leave and liberty granted.

The record indicates that, the Applicant is in Jail since 6th October 2015.

In view thereof, the learned Additional Sessions Judge, Borivali Division, Dindoshi, Mumbai seized of Sessions Case No. 12 of 2016 (arising out of CR No. 587 of 2015 registered with MIDC Police Station, Mumbai,), is hereby directed to expedite the trial and to make an endeavour to conclude the same within a period of one year from today.
