The grievance of the learned counsel appearing for the Petitioner is that the application filed under Section 41A of the Bombay Public Trust Act, 1950 in January, 2015 is not being decided by the Assistant Charity Commissioner.

A judicial notice will have to be taken of the fact that there is a huge pendency of various categories of matters before the Assistant Charity Commissioners in the State. Therefore, it is for the Assistant Charity Commissioner to decide which matter should be given priority. If the Petitioner wants priority to be given for the pending application, it is for him to make an application before the Assistant Charity Commissioner who shall decide the same in accordance with law.
