Heard learned counsel for both the parties.

It is pointed out by learned counsel for the respondent Nos.1 and 2 that the appellant-plaintiff had filed a Suit for infringement of trade mark. Even the respondents-defendants had filed a counter claim in the Suit. There is an interim order which was passed in the present Appeal which continues till date. The Suit is of the year 2012. It is informed that the Trial Court has fixed the Suit for framing issues.

In this view of the matter, the Trial Court is requested to dispose of the Suit as expeditiously as possible, preferably within a period of one year from today.

The ad-interim relief granted by this Court to continue till the disposal of the Suit.

Needless to mention that while deciding the Suit, the Trial Court will not be influenced by any of the observations made in the impugned order.

Appeal is disposed of.

In view of the disposal of the Appeal, Civil Application does not survive. Civil Application is disposed of accordingly. ( M. S. KARNIK, J. )
