DATED : 7th MAY, 2024 P.C:- Upon the letter addressed by Shri. Devendra Hindusingh Baghel, who is incarcerated since 22/06/2019, in connection with C.R. No.126/2019, which has invoked sections 307, 324, 504 of IPC, Ms. Priyanka Chavan was appointed through High Court Legal Services Committee, to assist the applicant, would submit that the applicant is incarcerated since 2019 and presently undergoing trial in Sessions Case No.687 of 2019.

The learned APP state that, the trial has commenced and two witnesses are examined.

Since the applicant face an accusation under Section 307, with a long incarceration of 5 years, I deem it appropriate to

2/3 2 BA 1025-23.doc direct his release on bail, subject to the following conditions: : ORDER :

(a) Application is allowed.

(b) Applicant-Devendra Hindusingh Baghel, shall be released on bail in connection with C.R.No.126 of 2019 registered with Vanrai Police Station, on furnishing P.R. Bond to the extent of Rs.25,000/- each, with one or two sureties in the like amount.

(c) The Applicant shall mark his attendance before the concerned police station on every Monday between 5.00 p.m. to 6.00 p.m.

(d) The Applicant shall attend the trial on every date and on his absence on two consecutive dates, the prosecution has liberty to move the Sessions Court requesting for he being taken into custody and upon such a conduct, the liberty conferred upon him shall automatically stand recalled without reference to this Court. (e) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Officer. The applicant shall not tamper with evidence. (f) On being released on bail, the Applicant shall furnish his contact number and residential address to the

3/3 2 BA 1025-23.doc Investigating Officer and shall keep him updated, in case there is any change.

The above order shall be communicated to the applicant through the Superintendent, Central Jail Thane, and the copy of the order shall be made available to the Superintendent by the learned APP.

The Court would like to express on record appreciation for Ms. Chavan, who has rendered effective assistance to the Court. The legal services Authority is directed to pay the legal remuneration to her within a period of six weeks from today.
