Heard learned counsel for the Petitioner.

It is the contention of learned counsel for the Petitioner that the impugned order is passed by the Chief Executive Ofcer only on the basis of the legal opinion received from the Legal Department. Mr. Deokar, learned counsel appearing on behalf of the Respondent Nos.1 and 2 on instructions fairly submitted that a fresh order would be passed on the basis of the materials on record and in accordance with law.

The impugned order is therefore quashed and set aside with liberty to the Respondent No.1 to pass a fresh order in accordance with law.
