1] This is an application under 439 of Cr. P.C. for bail in CR No. I211 of 2016 dated 24.9.2016 registered at Uran Police Station, DistrictRaigad under Sections 407, 411 r/w 34 of the Indian Penal Code. It is submitted that, in pursuance of Order dated 23rd August 2017, the Investigating Agency has verified the record/documents pertaining to the permanent residential address of the applicant at his native place and properties held by the applicant and his father and it is informed that the documents submitted to the Investigating Agency are 1/3

genuine documents.

2] It is the prosecution case that, the applicant and co-accused misappropriated the goods namely PVC resin powder of their employer. During the course of investigation, the applicant came to be arrested on 24.9.2016 and since then he is in jail. The co-accused namely Pintu Suresh Bind has already been released on bail by this Court. The record indicates that, the applicant has played same and/or similar role in the present crime as has been played by co-accused Pintu Bind. In view thereof, the applicant is entitled to be released on bail on the ground of parity. Hence, the following Order:

(i) The applicant be released on bail in CR No.I-211 of 2016 registered with Uran Police Statistic, District Raigad, on his furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) After his release from the jail, the applicant shall attend the concerned Uran Police Station on every 1st Monday of the month between 10.00 a.m. To 1.00 p.m.

(iii) Applicant shall attend all dates before the Trial Court. (iv) Any two consecutive defaults in complying with the 2/3

aforesaid conditions, shall attract the provisions of cancellation of bail. (v) Applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
