The Petitioners have challenged the order dated 12 November 2021 passed by the Sub Divisional Officer (Haveli), Pune under Section 17 (1) of the Maharashtra Highways Act, 1955 (the Act of 1955). By this order, the objections raised by the Petitioners have been rejected.

The learned Counsel for the Petitioners has sought to raise various contentions including competence of the authority to decide

Trupti 2 41-wp-12891-2022.doc the objections and also merits of the objections. The learned Counsel for Respondent No.4 points out that thereafter the matter has progress much further. Award is declared and the amount of almost Rs.2,500/- Crore has been disbursed. Therefore, at this stage, the challenge to the rejection of the objections is rendered in academic.

Leaving it open to the Petitioners to take steps as may be permissible in law and facts, we dispose of the writ petition. (M.M. SATHAYE, J.) (NITIN JAMDAR, J.)
