The petition is filed for transfer of investigation in FIR/CR No.I-108 of 2012 registered for offences punishable under Section 406, 409, 420, 465, 468, 471 read with Section 34 of the Indian Penal Code by the Murbad Police Station. 3.

The learned APP has placed on record a communication from the Sub Divisional Police Officer, Murbad Division, Murbad dated 07.03.2017. Perusal of the communication reveals that the N.S. Kamble page 1 of 2

12-wp-1675-2015 investigation in the subject FIR is completed and report has been submitted to the Judicial Magistrate First Class, Murbad Court under Section 169 of the Code of Criminal Procedure. In light of the said report, the relief sought by the petitioner to transfer the investigation of the first information report dated 31.08.2012 does not survive. The Writ Petition therefore disposed of. The petitioner is at liberty to file a protest affidavit opposing the report under Section 169 of the Code of Criminal Procedure.
