IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION APPEAL FROM ORDER NO. 395 OF 2016 WITH CIVIL APPLICATION NO. 517 OF 2016 Dr Kshitij Bipin Lanjekar ...Appellant

Versus

Tejaswini bipin Lanjekar & Anr

...Respondents

Mr Piyush Shah, for the Appellant.

CORAM: G.S. PATEL, J DATED:

21st June 2017 PC:- 1.

There is no manner of doubt that the domestic violence proceedings initiated by Defendant No. 1 will have to be disposed of on their own merits, and that the present Suit will have to be decided uninfluenced by the interim order under Appeal. 2.

The interim order is, however, not set aside. The conclusion that an injunction cannot be obtained in this suit, which would have the effect of reversing as if in appeal an independent order granted under Domestic Violence Act is correct and is affirmed. 21st June 2017

6-AO395-16.DOC 3.

The Appeal is dismissed with these observations. There will be no order as to costs.
