31. WP 2662.21.doc P.C. :- On the earlier occasion after hearing the learned Counsel for the Petitioners, we opined and recorded that the FIR cannot be quashed by consent. Since the Petition did not contain a challenge on merits of the FIR, the learned Counsel for the Petitioner had sought time.

Today, the learned Counsel for the Petitioners seeks leave to withdraw the Petition to challenge the FIR and charge-sheet on merits.

The Writ Petition is accordingly disposed of as withdrawn with liberty. If a a fresh Petition is filed, it is needless to state that it will be considered on its own merits. 4.
